- Deposit limit: The deposit may not exceed two months' rent for a term longer than month-to-month (one and one-half months' rent for a month-to-month tenancy) (N.C. Gen. Stat. § 42-51).
- Deposit return: within 30 days after termination of the tenancy and delivery of possession (N.C. Gen. Stat. § 42-52).
- Rent changes: North Carolina law prohibits local rent control (N.C. Gen. Stat. § 42-14.1). A month-to-month tenancy may be ended on seven days' notice (N.C. Gen. Stat. § 42-14), so the new rent may take effect for a month-to-month tenant after at least that notice, and only at the start of a rental period.

Frequently asked questions
- Does a landlord have to renew a lease in North Carolina?
- Generally no. In North Carolina, a landlord may decline to renew a lease at the end of its term for any lawful, non-discriminatory, non-retaliatory reason, after giving any notice the lease and state law require.
- Is a lease renewal a new lease?
- A renewal extends the existing lease for a new term, usually with the same terms except those the parties change, such as the rent. The Standard renewal keeps all original lease terms in effect unless it states a change.
- What is the difference between the Standard and Professional Lease Renewal Agreement?
- The Standard edition is a complete, state-aware Lease Renewal Agreement for common situations. The Professional edition adds longer clause coverage, schedules, and optional modules for more complex matters. You can preview either edition free before you pay.
