Illinois rules built into this template

  • Deposit return: within 45 days after the tenant vacates; if the landlord withholds any amount for damage, the landlord shall deliver an itemized statement of the damage, with copies of paid receipts or estimates as the statute requires, within 30 days after the tenant vacates (765 ILCS 710/1).
  • Rent changes: Illinois law prohibits local rent control (50 ILCS 825). For a month-to-month tenancy, a landlord must give at least 30 days' written notice to end the tenancy (735 ILCS 5/9-207), so a rent increase should be given with at least that much notice. Local ordinances, such as the Chicago Residential Landlord and Tenant Ordinance, may add requirements.

Frequently asked questions

Does a landlord have to renew a lease in Illinois?
Generally no. In Illinois, a landlord may decline to renew a lease at the end of its term for any lawful, non-discriminatory, non-retaliatory reason, after giving any notice the lease and state law require.
Is a lease renewal a new lease?
A renewal extends the existing lease for a new term, usually with the same terms except those the parties change, such as the rent. The Standard renewal keeps all original lease terms in effect unless it states a change.
What is the difference between the Standard and Professional Lease Renewal Agreement?
The Standard edition is a complete, state-aware Lease Renewal Agreement for common situations. The Professional edition adds longer clause coverage, schedules, and optional modules for more complex matters. You can preview either edition free before you pay.
