New York rules built into this template

  • Deposit limit: The deposit may not exceed one month's rent (N.Y. Gen. Oblig. Law § 7-108).
  • Deposit return: within 14 days after the tenant vacates the premises (N.Y. Gen. Oblig. Law § 7-108).
  • Rent changes: If the increase is 5% or more, New York requires written notice at least 30 days before it takes effect if the tenant has lived in the unit (or had a lease) for less than one year, 60 days for one to two years, and 90 days for two years or more; without timely notice, the current rent continues until the required notice period has run (N.Y. Real Prop. Law § 226-c). Rent-stabilized and rent-controlled units are limited to the increases set by the Rent Guidelines Board or the state housing agency. In New York City and localities that have adopted the Good Cause Eviction law, an increase above 5% plus inflation, or 10%, whichever is lower, may be presumed unreasonable for covered units (N.Y. Real Prop. Law art. 6-A).

Frequently asked questions

Does a landlord have to renew a lease in New York?
Generally no, unless the unit is rent stabilized or covered by a Good Cause Eviction law. A landlord who will not renew, or will renew at an increase of 5% or more, must give 30, 60, or 90 days' written notice depending on how long the tenant has lived there (N.Y. Real Prop. Law § 226-c).
Is a lease renewal a new lease?
A renewal extends the existing lease for a new term, usually with the same terms except those the parties change, such as the rent. The Standard renewal keeps all original lease terms in effect unless it states a change.
What is the difference between the Standard and Professional Lease Renewal Agreement?
The Standard edition is a complete, state-aware Lease Renewal Agreement for common situations. The Professional edition adds longer clause coverage, schedules, and optional modules for more complex matters. You can preview either edition free before you pay.
