- Tenancy type: This is a private residential tenancy under the Private Housing (Tenancies) (Scotland) Act 2016. It is open-ended and has no fixed end date: it continues until the tenant gives notice or the landlord obtains an eviction order on a statutory ground.
- Tenant notice: The tenant may end the tenancy by giving the landlord at least 28 days' written notice.
- Ending by the landlord: The landlord may end the tenancy only by serving a notice to leave on one of the statutory eviction grounds in the Private Housing (Tenancies) (Scotland) Act 2016, and, if the tenant does not leave, obtaining an eviction order from the First-tier Tribunal for Scotland (Housing and Property Chamber).
- Deposit: The landlord shall pay the deposit to an approved tenancy deposit scheme within 30 working days of the start of the tenancy and give the tenant the required information (Tenancy deposit Schemes (Scotland) Regulations 2011). The deposit may not exceed two months' rent.
- Rent increases: The landlord may increase the rent no more than once in any 12-month period, by giving the tenant at least three months' notice using the prescribed rent increase notice. The tenant may refer the increase to a rent officer at rent Service Scotland.
