England rules built into this template

  • Tenancy type: This is an assured periodic tenancy with monthly rent periods. Under the Renters' Rights Act 2025, private residential tenancies in England no longer have a fixed term: the tenancy continues from month to month until it is ended in one of the ways permitted by law.
  • Tenant notice: The tenant may end the tenancy by giving the landlord at least two months' written notice, ending at the end of a rent period.
  • Ending by the landlord: The landlord may end the tenancy only by obtaining a court order on one of the statutory grounds for possession in the Housing Act 1988 (as amended), after serving a valid notice under section 8 of that Act. "No-fault" notices under section 21 can no longer be used.
  • Deposit: The landlord shall protect the deposit in a government-authorised tenancy deposit scheme and give the tenant the prescribed information within 30 days of receiving it (Housing Act 2004, sections 213-215). The deposit is capped at five weeks' rent (six weeks' if the annual rent is £50,000 or more) under the Tenant Fees Act 2019.
  • Rent increases: The landlord may increase the rent no more than once a year, only by serving the statutory notice under section 13 of the Housing Act 1988 giving at least two months' notice. The tenant may challenge the proposed rent at the First-tier Tribunal. Any other rent review clause has no effect.

Frequently asked questions

Can I still use an assured shorthold tenancy or a section 21 notice in England?
No. Since 1 May 2026, under the Renters' Rights Act 2025, new private tenancies in England are assured periodic tenancies with no fixed term, existing assured shorthold tenancies became periodic, and landlords can no longer serve section 21 "no-fault" notices. The DraftMyDocu England tenancy agreement uses the new rules.
How much notice does a tenant need to give in England?
A tenant may end the tenancy by giving the landlord at least two months' written notice, ending at the end of a rent period.
What is the difference between the Standard and Professional Tenancy Agreement?
The Standard edition is a complete, state-aware Tenancy Agreement for common situations. The Professional edition adds longer clause coverage, schedules, and optional modules for more complex matters. You can preview either edition free before you pay.
