- Subletting: Under N.Y. Real Prop. Law § 226-b, a tenant in a building with four or more residential units may sublet with the landlord's written consent, which may not be unreasonably withheld. The request must be sent by certified mail, return receipt requested, with the information the statute lists and a copy of the proposed sublease; if the landlord does not respond within 30 days after the request or any additional information reasonably asked for, consent is deemed given. Rent-stabilized apartments are subject to additional rules, including limits on the rent charged to a subtenant.

Frequently asked questions
- Can I sublet my apartment in New York?
- Under N.Y.
- Am I still responsible to my landlord after I sublet?
- Yes. The original tenant stays responsible to the landlord for rent and all lease obligations unless the landlord releases them in writing. The Standard sublease makes the subtenant follow the master lease and ends automatically if the master lease ends.
- What is the difference between the Standard and Professional Sublease Agreement?
- The Standard edition is a complete, state-aware Sublease Agreement for common situations. The Professional edition adds longer clause coverage, schedules, and optional modules for more complex matters. You can preview either edition free before you pay.
