- Enforceability: Under N.Y. Gen. Oblig. Law § 5-326, a release of negligence is void if the Releasee is the owner or operator of a pool, gymnasium, place of amusement or recreation, or similar establishment and the Releasor pays a fee to use the facility. Other releases must clearly and unequivocally express an intent to release negligence.
- Limits: no state enforces a release of gross negligence, recklessness, or intentional misconduct, so the Standard release excludes those claims.

Frequently asked questions
- Are liability waivers enforceable in New York?
- Under N.Y. Gen. Oblig. Law § 5-326, a release of negligence is void if the Releasee is the owner or operator of a pool, gymnasium, place of amusement or recreation, or similar establishment and the Releasor pays a fee to use the facility. - Can a parent sign a liability waiver for a child?
- It depends on the state. Some states do not enforce a parent's pre-injury release of a minor's own claims, or enforce it only in limited situations, so the Standard release includes a parent signature only as an option.
- What is the difference between the Standard and Professional Release of Liability?
- The Standard edition is a complete, state-aware Release of Liability for common situations. The Professional edition adds longer clause coverage, schedules, and optional modules for more complex matters. You can preview either edition free before you pay.
